CJI reverses the previous policy, now OBC will have reservation in Supreme Court

Now the Other Backward Classes (OBCs) will have a reserved quota in the recruitment of employees in the supreme court of India. It was granted by the supreme court under dy chadruch and b gavai. And in the gazette notification that was issued on July 3 the powers that were conferred Nad Article146 (2) were used to amend the document “Supreme Court Officers and Servants (Conditions of Service and Conduct) Rules, 1961”.In line with the updated Rule 4A, “Reservations for Scheduled Castes (SC), Scheduled Tribes (ST), Other Backward Classes (OBC), Divang, ex-servicemen, and dependents of freedom fighters are provided direct recruitment as per the said notifications and orders from time-to-time issued by Government of India”. What was there till now?SC and ST reservations were only applicable for the Supreme Court staff appointments, and there was no clear provision for OBC. This is the first instance where OBC candidates will be eligible for court staff appointments. The new reservation system will be post based and not vacancy based. This is based on the landmark case R.K. Sabharwal vs State of Punjab, decided by a five-judge Constitution Bench of the Supreme Court in 1995. The ruling provided that reservation should be determined based on the post available rather than using annual vacancies as a metric. It stipulated that there should be separate rosters for direct recruitment and promotion. Furthermore, once a post is granted to a reserved category, it will be permanently classified as such, even after the retiree vacates the position.
