IRDAI Rolls Out Flexible 4-Layer System from December 15, 2026

In a consumer-centric reform set to reshape the Indian automotive insurance sector, the Insurance Regulatory and Development Authority of India (IRDAI) has notified a comprehensive 4-layer motor insurance architecture effective from December 15, 2026. Under the new regulatory framework, policyholders will no longer be locked into rigid, pre-packaged bundled insurance products when purchasing or renewing covers for two-wheelers and four-wheelers. Instead, vehicle owners will have the autonomy to select distinct coverage components tailored to their budget and driving habits, ending the compulsory bundling of non-essential add-ons while introducing transparent, itemized pricing across all general insurance providers in India. The 4-Layer Architecture: Navigating Mandatory Protections and Customizable Add-OnsUnder the IRDAI circular, auto insurance is officially segmented into four distinct layers balancing statutory road safety obligations with personalized financial protection. Layer 1 constitutes Third-Party Insurance, which remains legally mandatory under the Motor Vehicles Act to cover legal liabilities arising from third-party bodily injury, death, or external property damage. Layer 2 introduces an optional Passenger Legal Liability cover, allowing policyholders to purchase supplemental liability protection for car occupants, two-wheeler pillion riders, and employed chauffeurs. Layer 3 focuses on Personal Accident Cover, which remains compulsory for the owner-driver but transitions into an elective, optional add-on for occupants, pillion riders, and paid drivers. Finally, Layer 4 covers Own Damage (OD) protection, remaining completely optional so vehicle owners can decide whether to insure their own vehicle against accidental collisions, theft, fire outbreaks, and natural calamities based on their risk appetite.Mandatory Itemized Pricing and Customer Option Forms to End Hidden Premium CostsTo eliminate ambiguity and promote transparency in the retail insurance marketplace, the regulator has made it mandatory for every insurance carrier and online aggregator to display the exact premium breakdown for each of the four separate sections. Insurers will be prohibited from presenting bundled lump-sum figures without itemizing individual policy charges. Furthermore, companies must issue a standardized 'Customer Option Form' across both digital web portals and offline sales channels, requiring consumers to actively select or decline optional riders using explicit checkboxes before issuing an active policy, ensuring total transparency at the point of sale.Clarity on Passenger Safety and Explicit Exclusions for Immediate Family MembersThe reform also establishes critical clarity regarding passenger and pillion safety, resolving long-standing policy disputes where commuters were unsure whether co-passengers were financially indemnified during road accidents. While motorists can now choose dedicated coverage for colleagues, friends, or hired staff traveling in the vehicle, the insurance regulator has clarified the boundary lines of passenger liability. Specifically, the optional passenger liability cover will not extend to the registered vehicle owner or their immediate family members—defined as parents, spouse, and children—who must continue to rely on designated personal accident covers or independent health and life insurance plans for bodily injury indemnification.
