Panchkula Consumer Court Orders Full Refund and Compensation After 6 New ACs Fail


Purchasing brand-new home appliances to beat the scorching summer heat is meant to bring comfort, but for one Panchkula family, it turned into a nightmare when six out of seven newly installed air conditioners proved to be defective. Despite enduring repeated breakdowns and 16 frantic service visits that involved replacing major components like compressors and cooling coils, the units persistently failed to function. Stepping in to deliver a landmark ruling, the Panchkula Consumer Commission has ordered the manufacturing company and local dealers to refund the entire purchase price of the faulty units along with interest and heavy compensation for harassment.The Ordeal of Sector 17 Residents: 16 Service Requests and Endless BreakdownsThe grievance originated when Sameer Madan, along with family members Garima Madan and Poonam, residents of Sector 17, Panchkula, purchased seven Voltas inverter ACs between October 2023 and January 2024. However, as summer temperatures soared in March and April 2024, six of the newly installed units simultaneously developed severe technical malfunctions. Within a span of a few months, the aggrieved consumers logged approximately 16 service complaints. Although technicians scrambled to replace critical parts—including compressors, cooling coils, and sensors—the cooling issues persisted, forcing the family to rent heavy-duty tower ACs at steep daily rates of up to 1,000 rupees per unit to survive the heat.ITI Investigation Report Proves Decisive Evidence Against the CompanyDuring the legal proceedings before the Consumer Commission, the manufacturing company defended itself by claiming that the grievances were minor, addressed in a timely manner, and potentially caused by local environmental conditions. The Commission firmly rejected these arguments. The turning point in the case arrived with the submission of a technical investigation report by the Principal of the Government Industrial Training Institute (ITI), Bitna, dated January 14, 2025. The official report conclusively established that the ACs were fundamentally defective and incapable of proper operation despite the replacement of major internal parts.Substantial Penalties, Refund, and Compensation Ordered by the CommissionRuling decisively in favor of the consumers, the Panchkula Consumer Commission held the company and dealers liable for severe deficiency in service and the sale of substandard goods. The judicial body emphasized that consumers investing in brand-new appliances should never face such agonizing failures, particularly during their warranty periods. Consequently, the Commission issued strict directives for the following penalties:Full Refund: Complete reimbursement of 1,74,940 rupees for the six defective ACs.Annual Interest: Six percent per annum interest calculated on the refunded amount.Harassment Compensation: 20,000 rupees awarded for severe mental distress and physical harassment.Inspection and Litigation Fees: 3,000 rupees as technical inspection charges and 5,500 rupees toward litigation costs, bringing total punitive damages to 28,000 rupees.
